About Rutger Kleemans

Rutger sits in our intellectual property and information technology practice, and focuses on patent litigation and cross-border (EU) patent enforcement strategies.

He also handles both contentious and non-contentious trademark, copyright, design and slavish imitation/trade secret cases.

In particular, he litigates complex patent cases before the (specialised) Dutch courts and before the European Patent Office.

Rutger has been in the driving seat in pan-European patent litigations (offensive and defensive), including life-cycle management litigation, and is particularly active in the TMT (mobile communication), pharmaceutical, (bio)chemical, energy and consumer goods sectors.

Recent work

  • Acting in mobile communications litigation before courts in the Netherlands (offensive and defensive), PI proceedings (kort geding) and (accelerated) proceedings on the merits.
  • Co-ordinating and implementing a patent enforcement strategy in six jurisdictions, including in eastern Europe, involving pre-trial seizures, border enforcement, administrative proceedings, PI and substantive proceedings. This led to injunctions in the major European markets and the team won victories for the client in all jurisdictions. The case is now before the Supreme Court of the Netherlands, among others.
  • Acting in pharmaceutical patent litigation for various well-known global brands involving blockbuster drugs.
