About Patrick Swain
Patrick has extensive experience in a wide range of commercial disputes and investigations, including advising clients on M&A-related and other shareholder disputes, commercial fraud claims, professional negligence litigation and contentious insolvency.
He has worked in London, New York and (for a total of ten years) in Hong Kong, building up our Asia dispute resolution capability.
Patrick is a member of the City of London Litigation Sub-Committee, which monitors developments in civil litigation practice and procedure.
- litigation between Liverpool Football Club’s former owners and The Royal Bank Of Scotland - the dispute effectively resolved the outcome of the takeover battle for the club and included successfully obtaining three injunctions in a week and broad allegations of conspiracy, breach of duties and shadow directorship.
- the defendants in a case brought in the Cayman Islands in which a Taiwanese tycoon unsuccessfully asserted a right to sit on the board and to be involved with the management of a holding company (Fortuna Development Corporation). An eight week trial in the Grand Court in Cayman involved 16 witnesses of fact, giving evidence in English, Chinese and Vietnamese and expert evidence on the laws of Taiwan and Samoa.
- Accenture in a dispute with Centrica (British Gas) regarding alleged breaches of warranty concerning the creation and implementation of a new billing system for British Gas.
- an internal investigation into internal business practices of a FTSE-100 company.
Patrick was educated at Corpus Christi College, Oxford and is admitted in England and Wales and in Hong Kong.
