This case note discusses two Dutch Supreme Court cases (Maximov and Diag) which dealt with the recognition and enforcement of a foreign arbitral award that had either been set aside by the court in the place of arbitration or revised by a different arbitral tribunal. The author analyses the outcome of the two cases, in particular with respect to the powers of the Dutch court to allow recognition and enforcement notwithstanding a foreign annulment of the award.
